CVC §21200
Bicyclists have the same rights and responsibilities as motor vehicle drivers.
CVC §21202
Cyclists must ride as close as practicable to the right-hand side of the roadway—except when turning left, passing, or avoiding hazards.

E-Bike Regulations in San Diego - CA Assembly Bill 1096
Definition of E-Bikes
Under California law, e-bikes fall into three classes:
Class 1
Pedal-assist only, with a top speed of 20 mph
Class 2
Throttle-powered, also capped at 20 mph
Class 3
Pedal-assist only (no throttle) with a top speed of up to 28 mph
- Low-speed electric bikes with a top assisted speed of 20 mph are allowed wherever regular bikes can ride—unless a specific area prohibits them (per CA Assembly Bill 1096).
- Riders must be at least 16 years old to operate Class 3 e-bikes, and all Class 3 riders must wear helmets. Teens younger than 18 need to wear a helmet on Type 1 and Type 2 e-bikes.
- CA Assembly Bill 1096 prohibits operating a class 3 electric bicycle on certain paths, lanes, or trails, unless authorized by a local ordinance. It also allows local authorities or governing bodies to ban the operation of class 1 or class 2 electric bicycles on specific paths or trails through an ordinance.
- E-bikes must follow the same rules and regulations as regular bicycles. This includes but is not limited to, stopping at stop signs, riding at safe speeds based on current conditions, and the use of helmets for class 3 riders and teens under 18.

Optional Ban on Riders Under 12
The legislation gives San Diego County and its cities the option (not the obligation) to restrict e-bike use for kids under 12.
Fines
For the first 60 days after adoption, children caught riding will receive a warning. After that, a $25 fine will be imposed, unless they complete a certified e-bike safety course within 120 days, in which case the fine will be waived.
Documentation Requirement
Every stop, citation, or search related to this law must be documented, including details on race, gender, and age based on officer perception. A full report is required by January 1, 2028.
Education First
Before enforcement begins, cities must conduct a 30-day public awareness campaign to inform residents about the change.
